මාසයකට අධික කාලයක් තිස්සේ විවිධාකාර අයුරින් පැටලෙමින් පවතින දේශපාලන අර්බුදයට තවමත් විසඳුමක් ලැබී නැත. ජනාධිපති මෛත්‍රීපාල සිරිසේන ඉකුත් අඟහරුවාදා පැවැති ශ්‍රී ලංකා නිදහස් පක්ෂ විශේෂ සමුළුවේදී ප්‍රකාශ කළේ තවත් සතියක පමණ කාලයකදී දේශපාලන අර්බුදය මුළුමනින්ම විසඳෙනු ඇත කියාය. එහෙත් දේශපාලන විචාරකයන්ගේ අදහස ජනාධිපතිවරයාගේ ප්‍රකාශයට පටහැනිය.

පාර්ලිමේන්තු මන්ත්‍රීවරුන් 122ක් මහින්ද රාජපක්ෂ අග්‍රාමාත්‍ය ධුරයේ කටයුතු කිරීමට විරෝධය දක්වති. ඉන් බහුතරය එක්සත් ජාතික පෙරමුණේ මන්ත්‍රීවරුය. එක්සත් ජාතික පෙරමුණ සිය ස්ථාවරය වෙනස් නොකරමින් රනිල් වික්‍රමසිංහට අග්‍රාමාත්‍ය ධුරය ලබාදෙන ලෙස බලපෑම් කරයි. එහෙත් ජනාධිපතිවරයා දැඩි තීන්දුවක් ගෙන තිබේ. මේ පාර්ශ්ව දෙක අතර මත ගැටුම හේතුවෙන් රට දිනෙන් දින අරාජිකත්වය කරා ගමන් කරමින් තිබේ. රාජ්‍ය ආයතනවල කටයුතු නිසි පරිදි සිදුනොවන බවට ඇතැම් පිරිස් කරුණු හුවා දක්වති. ජනාධිපතිවරයා උපදෙස් ලබාදුන්නද රාජ්‍ය නිලධාරීන්ද තීන්දු තීරණ ක්‍රියාත්මක කිරීමේදී පසුගාමී බවක් පෙන්නුම් කරන බවද පැවසේ. ඒ අතර රට ජාත්‍යන්තර වශයෙන් අපකීර්තියකට පත්වන්නට පටන්ගෙන ඇත.



“මේවගේ තත්ත්වයක් තවදුරටත් ඉදිරියට ඇදගෙන යන්න බැහැ. එක්කෝ ජනාධිපතිවරයා අඩියක් පස්සට ගන්න ඕනේ. නැත්නම් එජාපෙ වෙනත් අගමැති අපේක්ෂකයකු නම් කරන්න ඕනේ. මේ දෙකම නොවෙනතාක් අර්බුදය දිගටම පවතිනවා මිසක් විසඳුමක් ලැබෙන්නේ නැතැයි” දේශපාලන විචාරකයෝ පවසති. අභියාචනාධිකරණය මගින් ඉකුත් සඳුදා ලබා දුන් අතුරු තහනම් නියෝගය ප්‍රකාශයට පත්වීමත් සමග මහින්ද රාජපක්ෂ පිළට අයත් මන්ත්‍රීවරු හිටපු ජනාධිපතිවරයාගේ විජේරාම නිල නිවසට රැස්වූහ. හදිසි රැස්වීමක් ලෙසම නොව සාකච්ඡාවක් ලෙස එම රැස්වීම පැවති අතර අධිකරණ තීන්දුව පිළිබඳව එහිදී මන්ත්‍රීවරු සාකච්ඡා කළහ. හිටපු ජනාධිපති මහින්ද රාජපක්ෂගේ ප්‍රධානත්වයෙන් පැවැති එම සාකච්ඡාවේදී අධිකරණ තීන්දුවට ගරු කළ යුතු බවට තීන්දුවක් ගත් නමුත් පොහොට්ටුවේ මන්ත්‍රීවරුන් වැඩි පිරිසකගේ තීන්දුව වූයේ අභියාචනාධිකරණ තීන්දුවට එරෙහිව ශ්‍රේෂ්ඨාධිකරණය වෙත යෑමටය. ඒ අනුව හිටපු ඇමැතිවරුන් පිරිසක් එක්ව ශ්‍රේෂ්ඨාධිකරණයට ඉකුත් අඟහරුවාදා නඩුවක් ගොනු කළේය.

මේ අතර අද තීරණාත්මක දිනයක් ලෙස ප්‍රකාශ වී තිබුණේ පාර්ලිමේන්තුව විසුරුවා හැරීම සම්බන්ධයෙන් ජනාධිපතිවරයා ගත් පියවර පිළිබඳව ශ්‍රේෂ්ඨාධිකරණය තීන්දුවක් ප්‍රකාශ කිරීමට නියමිත වන හෙයිනි. “බ්‍රහස්පතින්දා වනතෙක් නඩුව අහලා බොහෝවිට සිකුරාදා තීන්දුවක් දෙන බව පැවසෙනවා. එහෙම නැත්නම් ලබන සඳුදා දිනයේදී තීන්දුව ප්‍රකාශ කිරීමට නියමිතයි” යැයි නීතිඥයෝ පිරිසක් අනාවැකි පළකළහ.

“පාර්ලිමේන්තුව විසුරුවා හැරියත් එය තවදුරටත් පවත්වාගෙන ගියත් මෛත්‍රීපාලගේ ආණ්ඩුවකට ඉදිරියට යන්න බැහැ. ඒ නිසා ඉතාම ඉක්මනින් රටට මහ මැතිවරණයක් අවශ්‍යයි. ජනාධිපතිවරයාගේ පාර්ශ්වයයි එක්සත් ජාතික පක්ෂයයි එක මතයකට ඇවිත් පාර්ලිමේන්තු මහ මැතිවරණයකට එන්න ඕනේ” යැයි දේශපාලන විචාරකයෝ පෙන්වා දෙති.

මැතිවරණ කොමිෂන් සභාව ඉදිරි වසර දෙක ඇතුළත ජාතික මැතිවරණ තුනක් පැවැත්වීම සඳහා සූදානමින් පසුවෙයි. මැතිවරණ කොමිෂන් සභාවේ සභාපති මහින්ද දේශප්‍රිය සඳහන් කරනුයේ “ලබන 2020 අවුරුද්ද අවසන් වීමට පෙර මැතිවරණ තුනක් අපට පවත්වන්න සිද්ධවෙනවා. දහනව වැනි ව්‍යවස්ථාවට අනුව ජනාධිපතිවරයාගේ ධුර කාලය අවුරුදු 5 යි. ඒ අනුව 2020 ජනවාරි 8 වැනිදායින් ජනාධිපතිවරයාගේ නිල කාලය අවසන් වෙනවා. ජනාධිපතිවරයාගේ නිල කාලය අවසන් වීමට මාස දෙකකට පෙරාතුව ජනාධිපතිවරණය පැවැත්වීම නීතියයි. ඒ අනුව අපට 2019 වසරේ නොවැම්බර් මාසයේදී ඒ මැතිවරණය තියන්න වෙනවා. 2019 වසර ආරම්භ වනවිට සියලුම පළාත් සභාවල නිල කාලය අවසන්. ඒ අනුව පළාත් සභා 9 ම මැතිවරණය තියන්න වෙනවා. 2020 අගෝස්තු මාසය වනවිට පාර්ලිමේන්තුවේ නිල කාලය අවසන් වෙනවා. ඒ අනුව ඒ කාලයට පෙර හෝ ඊට කලින් හෝ අපට පාර්ලිමේන්තු මැතිවරණයක් පවත්වන්නට සිදුවේවි. ඒ අනුව අපට ජාතික මැතිවරණ තුනකට සූදානම් වෙන්න සිද්ධ වෙනවා” යැයි මහින්ද දේශප්‍රිය සඳහන් කරන්නේය.

කැබිනට් අමාත්‍ය ධුරවල බලතල අත්හිටවුවද ලේකම්වරුන්ට සාමාන්‍ය පරිදි කටයුතු පවත්වාගෙන යාමට ඉකුත්දා ජනාධිපතිවරයා උපදෙස් දුන්නේය. කොළඹ ජනාධිපති කාර්යාලයට කැඳවා අමාත්‍යංශ ලේකම්වරුන්ට ජනාධිපතිවරයා උපදෙස් ලබාදීම සම්බන්ධයෙන් විපක්ෂයෙන් වෙනත් මතයක් කරළියට පැමිණ තිබේ.

“ආණ්ඩුක්‍රම ව්‍යවස්ථාවේ 48 වැනි වගන්තියට අනුව ඇමැතිවරුන්ගේ බලතල අක්‍රියවනවිට ඒ සමගම ලේකම්වරුන්ගෙත් බලතල අක්‍රීය වෙනවා. ඒ අනුව දැන් ඉන්න ලේකම්වරුන්ට කටයුතු කරන්න බලයක් නැහැ” යැයි එක්සත් ජාතික පක්ෂයේ මන්ත්‍රීවරු තර්ක කරති.
අග්‍රාමාත්‍ය ධුරය සම්බන්ධයෙන් පැනනැගී ඇති දේශපාලන ගැටලුව පිළිබඳව ජනාධිපති මෛත්‍රීපාල සිරිසේන සහ එක්සත් ජාතික පෙරමුණේ නායකයන් අතර ඉකුත් සඳුදා රාත්‍රියේ විශේෂ සාකච්ඡාවක් පැවැති අතර එය අසාර්ථක වූයේය. සාකච්ඡාව අසාර්ථකවීම සම්බන්ධයෙන් එක්සත් ජාතික පෙරමුණේ නායකයෝ කනස්සල්ලටත් කෝපයටත් පත්ව සිටිති. සාකච්ඡාවෙන් අනතුරුව හිටපු ඇමැති මනෝ ගනේෂන් සිය ට්විටර් ගිණුමෙහි සටහනක් තබා තිබුණේය. “මට තවදුරටත් දේශපාලනමය වශයෙන් පීඩනයක් ඇතිවුණොත් මම ජනාධිපති ධුරයෙන් ඉල්ලා අස්වෙනවා. ගිහින් පොළොන්නරුවේ ගොවිතැන් කරනවා යැයි ජනාධිපතිතුමා ප්‍රකාශ කළා” යනුවෙන් මනෝ ගනේෂන් සිය ට්විටර් ගිණුමෙහි සඳහන් කර තිබිණ. ඒ පිළිබඳව මනෝ ගනේෂන් සහතික වන අතර “ජනාධිපතිතුමා එහෙම කියනකොට තවත් ඇමැතිවරු එතන හිටියා. හකීම්, කිරිඇල්ල, රාවුෆ් මේ හැමෝම හිටියා” යැයි මනෝ ගනේෂන් සඳහන් කරන්නේය.
මේ අතර ඉකුත් සඳුදා පැවැති එම සාකච්ඡාව ඉතාම අසාර්ථක වූයේ ජනාධිපතිවරයා ස්ථිර තීන්දුවක් ගෙන තිබූ හෙයිනි.

එක්සත් ජාතික පෙරමුණේ නායකයෝ රාත්‍රී අට පසුවෙද්දී ජනාධිපති ලේකම් කාර්යාලයට පැමිණ සිටියහ. සියලුදෙනා විශ්වාස කර තිබුණේ ජනාධිපතිවරයා එජාපෙට සතුටුදායක තීරණයක් දෙනු ඇත කියාය. එක්සත් ජාතික පෙරමුණේ නායකයන් අසුන්ගෙන සිටිද්දී ජනාධිපතිවරයා තරමක් දැඩි ස්වරූපයෙන් පැමිණ වාඩිවූයේය. ජනාධිපතිවරයා අසුන් ගැනීමට පෙරම “ඔයගොල්ලොට ඉන්නේ රනිල්ම විතරද එහෙම නම් කරන්න දෙයක් නැහැ. වෙන කෙනෙක් නැද්ද” යැයි ජනාධිපතිවරයා පැවසුවේය. ජනාධිපතිවරයාගේ ප්‍රශ්නයට පිළිතුරු බඳින්නට ඉදිරිපත් වූයේ නියෝජ්‍ය නායක සජිත් ප්‍රේමදාසය. “ජනාධිපතිතුමනි, අපට බහුතරය තියෙනවා ඔබතුමා බහුතර බලයක් තියෙන පැත්තට ආණ්ඩුව දෙන්න. එක්සත් ජාතික පක්ෂය හැටියට අග්‍රාමාත්‍යවරයා ලෙස අපි ඉදිරිපත් කරන්නේ රනිල් වික්‍රමසිංහ නායකතුමා අපි වෙන කෙනෙක් ගැන හිතලවත් නැහැ” යැයි සජිත් කීවේය. සජිත් ප්‍රේමදාසගේ කතාවෙන් පසුව ලක්ෂ්මන් කිරිඇල්ල ද ජනාධිපතිවරයාට කරුණු කීවේය. ලක්ෂ්මන් කිරිඇල්ල තරමක ආවේගයකින් අදහස් දැක්වූයේය. “ජනාධිපතිතුමනි, ඔබතුමා බරපතළ තීන්දු දෙකක් ගත්තා. ඒ තීන්දු දෙකම නිවැරදි නැති බව සනාථ වෙමින් තියෙනවා. අපට බහුතරය තියෙන නිසා ඔබතුමා නිවැරදි තීන්දුවක් ගන්න. මෙතන ඔබතුමාගේ පුද්ගලික කැමැත්ත අකමැත්ත වැඩක් නැහැ” යැයි කිරිඇල්ල කී කතාවට ජනාධිපතිවරයාට ද තරමක් කේන්ති ගියේය. දෙසිය විසිපහම ආවත් රනිල්ට නම් දෙන්නේ නැතැයි ජනාධිපතිවරයා කීවේ ඉන්පසුවය. ලක්ෂ්මන් කිරිඇල්ල ජනාධිපතිවරයාට තවත් කතාවක් කීවේය. “ඔබතුමා ආණ්ඩුක්‍රම ව්‍යවස්ථාව උල්ලංඝනය කළ බව ඔප්පු වුණොත් ඔබතුමාට හිරෙත් යන්න වෙනවා යැයි සමහර නීතිඥයෝ කියනවා” කිරිඇල්ල කීවේය. එවිට එක්සත් ජාතික පෙරමුණේ නායකයෝ නැගිට යන්නට ගියෝය.

පවතින දේශපාලන අර්බුදය පිළිබඳව දෙමළ ජාතික සන්ධානය ද යම් අවුල් සහගත තත්ත්වයකට පත්ව තිබේ. දෙමළ ජාතික සන්ධානයේ හවුල්කාර පක්ෂ නායකයෝ ඉකුත්දා රැස්වී ඒ පිළිබඳව සාකච්ඡා කළහ. එහිදී දෙමළ සන්ධානයේ පොදු මතයට ටෙලෝ සංවිධානය බාල්දියක් දැම්මේය. ටෙලෝ සංවිධානය වෙනුවෙන් පාර්ලිමේන්තු මන්ත්‍රීවරුන් වන සෙල්වම් අඩෙක්කලනාදන් හා විනෝනාරාදයන් ද හිටපු පාර්ලිමේන්තු මන්ත්‍රීවරුන් වන එම්.ජී. සිවාජිලිංගම්, එන්. ශ්‍රීකාන්තා සහ කේ. කරුණාකරන් ද සහභාගි වූහ. එහිදී ටෙලෝ සාමාජිකයින් කීවේ “හැමදාම දකුණේ නායකයින් අපි රැවැට්ටුවා. අපට හැමදාමත් රැවටෙන්න බැහැ. මේ පාර එක්සත් ජාතික පෙරමුණට සහාය දෙනවා නම් ලිඛිතව කොන්දේසි පහක් යටතේ ගිවිසුමක් ගහන්න ඕනේ. උතුරු නැගෙනහිර පළාත්වල අපේ ඉඩම් නිදහස් වෙන්න ඕනේ. ත්‍රස්තවාදය වැළැක්වීමේ පනත අහෝසි කළ යුතුයි. උතුරු හා නැගෙනහිර යළිත් ඒකාබද්ධ විය යුතුයි.

Court extends ban on president sacking parliament

AFP - Sri Lanka's highest court Friday banned President Maithripala Sirisena from sacking the legislature until it decides on the legality of his move last month to call snap elections.

The Supreme Court concluded hearing 10 petitions against Sirisena's move as part of a bitter power struggle with his erstwhile prime minister Ranil Wickremesinghe, but reserved judgement for an unspecified date.

The courts reopen on Monday.

Sirisena plunged the country into crisis on October 26 when he fired Wickremesinghe and appointed the contentious Mahinda Rajapakse in his place.

He then dissolved parliament on November 9 and called elections nearly two years ahead of schedule on January 5.

Four days after he sacked parliament through a special decree, the Supreme Court issued an interim ruling suspending Sirisena's action and restoring parliament, which almost immediately passed a no-confidence motion against Rajapakse.

"The court issued a fresh order extending the ban on the president until the case is concluded," a court official told reporters after the unusually long hearing on Friday marking four days of legal arguments.

Security was stepped up outside the Supreme Court amid expectations of a final ruling on Friday evening.

The court's seven-judge bench is expected to deliver a ruling on the constitutionality of Sirisena's move as early as Monday.

Sacked premier Wickremesinghe's party and their allies, who command a majority in the 225-member assembly, have suggested they could begin impeachment proceedings against Sirisena depending on the ruling.

Wickremesinghe's party loyalists believe the court decision will go in their favour, a view held by many independent lawyers.

Problems for Sirisena were compounded on Monday when the Court of Appeal suspended the entire cabinet and asked Rajapakse to explain on what authority he was holding office.

With parliamentary proceedings degenerating into brawls, the United States, the European Union and other powers have raised concerns over the crisis in the strategically important island nation of 21 million people.

Only China has recognised the appointment of Rajapakse, who during his decade as president until 2015 relied heavily on Beijing for diplomatic and financial support.

As president from 2005 until 2015, he ended Sri Lanka's four-decade civil war in 2009 by crushing the rebel Tamil Tigers.

But 40,000 ethnic Tamils were allegedly massacred in the process.

Rajapakse and his family are also alleged to have profited from his time in power through corrupt deals.

During an earlier stint as prime minister from 2001 until 2004, Wickremesinghe is credited with pulling Sri Lanka out of its first ever recession, in part with reforms that have endeared him to the West.

Mahinda failed due to high price of defectors: Sri Lanka President

ECONOMYNEXT – Mahinda Rajapaksa failed to secure a majority in parliament because MPs demanded over 500 million rupees each to defect, President Maithripala Sirisena said yesterday acknowledging that his power grab had backfired.

President Sirisena in a video interview with the Daily Mirror admitted that the man he controversially installed as Prime Minister on October 26 did not have a majority in the 225-member assembly despite confident claims at the time.

Sirisena had told a public rally on November 3 near parliament that he had secured over 113 legislators to support Rajapaksa who was made prime minister after sacking Ranil Wickremesinghe.

"Do not fear. We have already got more than 113," Sirisena announced at a rally dubbed 113 Plus.

The president said MPs were being offered over 500 million rupees to defect and the high price prevented Rajapaksa gathering enough support to form a government.

"The price of an MP was over 500 million rupees. This is unbelievable. This (high price) is what stopped from Mahinda Rajapaksa from getting a majority," President Sirisena said blaming Rajapaksa for his failure.

"If Mahinda was able to get the 113 MPs to support him, this problem would not have dragged

for over one and a half months. We wouldn’t have faced this political crisis. We wouldn’t be facing this political unrest," Sirisena said.

At least one legislator from the United National Party (UNP) who was approached by Sirisena’s party to defect said he was offered 500 million rupees and an apartment in Malaysia along with free passage for the entire family to a foreign destination.

Several UNP Mps said the purchase of MPs was financed by China, an allegation Beijing denied.

Sirisena who had previously said he would end the political deadlock by Tuesday (Dec 11) announced that he would abide by the Supreme Court’s decision on the legality of his dissolution of parliament on November 9.

The president initially prorogued parliament for 20 days saying it was to give time to Rajapaksa to unveil a new budget, but his loyalists admitted that it was really to give nearly three weeks to Rajapaksa to cobble together a majority.

With the writing clearly on the wall, Sirisena eventually sacked the legislature and called snap elections for January 5 after realizing that Rajapaksa had no way of mustering a majority in the 225-member assembly where Wickremesinghe’s party enjoyed the support of over 113.

Rajapaksa lost two no-confidence motions brought against him and his purported cabinet on November 16 and 16, but Sirisena refused to accept it and insisted on keeping his disputed government going.

However, the Court of Appeal on December 3 suspended Rajapaksa as well as his disputed cabinet pending a final hearing into a petition filed by 122 MPs. (COLOMBO, December 8, 2018)

Sri Lanka heads for government shut down as crisis drags

ECONOMYNEXT - The public sector could be at a standstill from the end of the month unless the political power struggle is ended and parliament makes urgent arrangements to meet expenditure in the New Year, officials warned Saturday.

President Maithripala Sirisena triggered the unprecedented crisis by sacking Prime Minister Ranil Wickremesinghe just 10 days before the unveiling of the on November 5. The disputed government he installed has failed to announce a promised vote-on-account in place of a budget.

Contrary to claims from Sirisena loyalists that the president could directly spend money from the consolidated fund for three months in the absence of a budget, the constitution makes such provision only in the event when parliament stands dissolved.

"We are in uncharted waters. There is no way the president can order spending when parliament is in session,” a senior finance ministry official said asking not to be named. “Unless some emergency measure is taken, there will be no legal way to finance government spending from January 1.”

Article 150 (3) of the constitution allows the president to spend money from the consolidated fund for three months only at a time when he has dissolved parliament before a budget has been approved by the House.

Sirisena’s sacking of the legislature on November 9 is currently being challenged before the Supreme Court and a verdict is expected tomorrow or this week at the latest.

The court suspended Sirisena’s gazette notification dissolving parliament and calling a snap election for January 5. The Supreme Court ruling will have far reaching ramifications not only for the bitter power struggle but also public finances.

-Secretaries have no authority-

Even the state spending after November 30 is highly questionable given that parliament with an absolute majority voted to stop all non-essential spending of the state. A day earlier, it voted to block any spending by the Secretary to the Prime Minister.

On Monday, President Sirisena met with ministry secretaries he had appointed recently and ordered them to continue with their work to ensure public services were maintained, but legal experts noted that the president did not have such powers as the secretaries were no longer in office.

Under Article 52 (3) of the constitution, the secretaries to all ministries lose their jobs when the prime minister is defeated in a no-confidence motion, resigns or otherwise removed from his position. The purported prime minister lost a no-confidence motion (NCM) on November 14.

The Court of Appeal on December 3 issued an interim order suspending Mahinda Rajapaksa from exercising the powers of the prime minister until he can prove on what authority he is holding office after losing a NCM.

Senior treasury officials last week alerted government suppliers that they may not get paid on time unless the political crisis was resolved and a government was re-established before the end of the year.
Many ministry secretaries avoided signing any documents. When they did it was mostly backdated to avoid any future prosecution.

“The Secretary to a ministry shall cease to hold office upon the dissolution of the cabinet of ministers under the provisions of the constitution…,” according to Article 52 (3) which applies in this case, officials noted.

The Court of Appeal decision on the Quo Warranto demanding on what basis Rajapaksa and his cabinet were holding office after losing an NCM is due this week. The court upholding the petition by 122 Members of parliament could leave all ministry secretaries exposed to criminal prosecution.

President Sirisena noted last week that he would end the power struggle by Tuesday (December 11) but did not say how. He could be banking on the Supreme Court ruling in his favour over the legality of his dissolving parliament.

Should the Supreme Court hold against him, Sirisena could become exposed to impeachment as well as criminal prosecution soon after he leaves office. The immunity of the president is for himself against prosecution while in office, but the day he leaves he could be charged for any action committed while in office.

Former President Chandrika Kumaratunga had to pay fine three million rupees over an unlawful land acquisition and subsequent sale of such land for the Water’s Edge development while she was in office.
While faulting her for the transaction, the court held that the fine on her was a token that was expected to serve as a deterrent to others.

“We believe such a token payment of the real loss to the state of several hundreds of millions, will serve to "remind" present and future state actors and agencies (i) of their paramount duty to further the Public Trust and (ii) that their actions are subject to the Rule of Law,” the three-judge bench said in its judgement SC 352/2007.

This landmark judgement could be used in respect of many state officials and politicians, including Sirisena. (Colombo)

Sri Lanka President faces fresh challenge over his mental health

ECONOMYNEXT – President Maithripala Sirisena Monday faced a new challenge from an unexpected source questioning his mental condition to govern the country as a political crisis triggered by him dragged without any sign of resolution.

A public interest case was filed by a woman activist identified as Thakshila Jayawardena who argued that “irrational” behavior of the president was due to severe stress of adjusting to an urban life style, depression caused by the recent arrest of his chief of staff while taking a bribe and genetics.

Attorney Sisira Kumara Siriwardena said he hoped the Court of Appeal will take up the case, although many in the legal fraternity casts doubts if it will be entertained as the president enjoyed immunity.

“We are asking that he be subjected to an examination by a board of doctors at the Angoda mental hospital to establish if he is of sound mind,” Siriwardena told reporters outside the court.

He said Sirisena’s daughter’s book entitled “Janapathy Thaatha – President father“ spoke of mental illness running in the family. That could be the explanation for some of his controversial actions and statements recently, the lawyer argued.

He said the case was filed as a public interest litigation and they expected to be heard by the courts which are currently hearing several other action against Sirisena’s recent decisions to sack parliament as well as his prime minister Ranil Wickremesinghe.

A decision on the legality of Sirisena dissolving parliament on November 9 is due to be delivered later this week. The hearing in that case ended on Friday and a decision was expected on Monday, but lawyers said they now expect a judgment anytime between Wednesday and Friday.

Another decision on the legal authority of Mahinda Rajapaksa and his cabinet to hold office is also expected later this week. (COLOMBO, December 10, 2018)

ඇමරිකාවේ සිල්ලර තෙල් මිල ඇමරිකාව ඇතුලෙ සාධක කළමනාකරණය කරමින් පාලනය කරනවාට වඩා පහසුවෙන් සවුදි අරාබිය වගේ රටක් හරහා වක්‍ර ලෙස පාලනය කිරීම ඇමරිකන් ජනාධිපතිවරයෙකුට පහසුයි. ජමාල් ඛශෝගි ඝාතනය පිළිබඳව සවුදි රජ කුමරු වෙත සීඅයිඒ ඇඟිලි දික් වෙද්දී, ජනාධිපති ට්‍රම්ප් විසින් දැක්වූ ඇල්මැරුණු ප්‍රතිචාරය වැනි දේ හරහා ලෝක තෙල් මිල පාලනය කළ හැකියයි ජනාධිපති ට්‍රම්ප් සිතනවා විය හැකියි. ඔහු එසේ පෙන්වනවා පමණක් වෙන්නත් පුළුවන්.

ජනාධිපති ට්‍රම්ප්ගේ ඉලක්කය වුනේ පසුගිය දෙදින පැවති ඔපෙක් රැස්වීමයි. තමන් සවුදි අරාබිය කළමනාකරණය කිරීම මඟින් තෙල් මිල පාලනය කරන බව ජනාධිපති ට්‍රම්ප් සිය අනුගාමිකයින්ට පෙන්වන්න හැදුවත් ඇත්තටම වී තිබෙන්නේ සවුදි අරාබියට තිබෙන විකල්ප කොහොමටත් සීමා වී තිබීමයි. ජනාධිපති ට්‍රම්ප් එහි වාසිය ගන්න උත්සාහ කරනවා.

ලෝක තෙල් වෙළඳපොළ තුළ පසුගිය සියවසේ දෙවන අර්ධය තුළ පැවති තත්ත්වයන් මේ වන විට බොහෝ දුරට වෙනස් වී තිබෙනවා. ඒ වෙනස ලෝක දේශපාලනයත් වෙනස් කර තිබෙනවා. දශක ගණනවක් ගත වීමෙන් පසුව වුවත් නිදහස් වෙළඳපොළෙහි "අදිසි හස්තය" ලෝක තෙල් මිලේ සුක්කානම අතට ගනිමින් සිටිනවා. ඒ නිසා, අනාගතයේදී කිසිදු රටකට තෙල් සම්පත් හිමිකම් මත පදනම්ව ලෝක දේශපාලනයට බලපෑම් කිරීම පහසු වෙන එකක් නැහැ.

ඔපෙක් රටවල් හා රුසියාව ඇතුළු ඇතැම් ඔපෙක් නොවන රටවල් විසින් දිනකට බැරල් මිලියන 1.2කින් නිෂ්පාදනය අඩු කිරීමට අවසාන වශයෙන් එකඟ වීමෙන් පසුව තෙල් මිල ඩොලර් දෙක තුනකින් වැඩි වී තිබෙනවා. එය විශාල වැඩි වීමක් කියා කියන්න අමාරුයි. කොහොම වුනත්, නිෂ්පාදන කප්පාදුව නිසා තෙල් මිල ඩොලර් පණහ මට්ටමෙන් පහළට වැටෙන එකක් නැහැ.

Ousted Sri Lanka PM’s right to remain an MP challenged

ECONOMYNEXT – Sri Lanka’s controversially ousted prime minister Ranil Wickremesinghe’s ability to remain a member of parliament was challenged in the Court of Appeal by the Sirisena-Rajapaksa alliance Tuesday.

A member of the Sri Lanka Podujana Peremuna (SLPP) filed the challenge on the basis that Wickremesinghe held 1.33 percent of equity in Lake House Printers, a publicly listed company, in violation of the constitution.

The court is yet to say if it will entertain the complaint, a copy of which was distributed to the media by the president’s media unit on Tuesday evening.

The petitioner, Sharmila Roweena Jayawardene Gonawela of 30/2, Albert Crescent, Colombo 07 asked the court to issue an interim order preventing Wickremesinghe voting in parliament until the conclusion of her petition.

She argued that Article 91(1)(e) of the constitution prevented individuals who hold any interest in public contracts running for parliament.

The provision says a candidate who “has any such interest in any such contract made by or on behalf of the State or a public corporation as parliament shall by law prescribe,” shall not be entitled to be a candidate or hold office as an MP.

Lake House Printers of which Wickremesinghe holds 1.33 percent share is a supplier of cheque leafs to two state-banks and therefore he should be disqualified from being an MP, the petitioner argued.

The case was filed a day ahead of a vote in parliament to express confidence in Wickremesinghe and seek his reinstatement as Prime Minister.

President Sirisena has maintained that he will not re-appoint Wickremesinghe even if the entire parliament wanted him back. (COLOMBO, December 11, 2018)

Court to hear Rajapaksa quo warranto case on Jan 16

ECONOMYNEXT - Sri Lanka's Court of Appeal will hear a case where Mahinda Rajapaksa has been asked to justify how he was in office as Prime Minister on January 16, lawyers said.

The court of appeal has already suspended Rajapaksa from holding office as Prime Minister pending the final decision of the so-called 'quo warranto' case.

Rajapaksa has also appealed the interim order where he was barred from acting in office, in Supreme Court.

In the morning, lawyers for the petitioners said they have not been noticed, when the case was first mentioned.

The quo warranto case will now be heard on 16, 17 and 18 of January next year.

මෙහිදී එක්සත් ජනතා නිදහස් සන්ධානයේ සිට එක්සත් ජාතික පක්ෂයට සහය පළ කළ ඒ එච් එම් ෆවුසි සහ පියසේන ගමගේ ද රනිල් වික්‍රමසිංහට සහය දෙමින් ඡන්දය භාවිත කළහ.

නොවැම්බර් 29 වන දා ජනාධිපතිවරයාට ලිපියක් යවමින් දෙමළ ජාතික සන්ධානය ප්‍රකාශ කළේ, මහින්ද රාජපක්ෂ ආණ්ඩුවට පාර්ලිමේන්තුවේ සහය නොමැති අවස්ථාවක ඔක්තෝබර් 26 වන දාට පෙර ආණ්ඩුව යළි ඇති කිරීම සඳහා පාර්ලිමේන්තුවේ බහුතරය ඇති එක්සත් ජාතික පෙරමුණේ නියෝජිතයාට දෙමළ ජාතික සන්ධානය සහය පළකරන බවය.

යෝජනාව සම්මත වීමෙන් අනතුරුව අදහස් දැක්වූ එක්සත් ජාතික පක්ෂ නායක රනිල් වික්‍රමසිංහ යෝජනාවට සහය ලබාදුන් සියළු මන්ත්‍රීවරුන්ට සහය පළකළේය. ව්‍යවස්ථාව ආරක්ෂා කිරීම සියළු දෙනාගේ වගකීම බව පැවසූ රනිල් වික්‍රමසිංහ ශ්‍රී ලංකාවේ තිබෙන්නේ පාර්ලිමේන්තු ආණ්ඩුක්‍රමයක් බව ප්‍රකාශ කළේය.

ඒකීය රාජ්‍යයක් තුළ බෙදන්න බැරි ශ්‍රී ලංකාවක් තුළ දේශපාලන විසඳුමක් ලබාදීම සඳහා කැපවී කටයුතු කරන බව පැවසූ රනිල් වික්‍රමසිංහ උතුරේ ජනතාවගේ ප්‍රශ්න විසඳීමටද කටයුතු කරන බව මෙහිදී ප්‍රකාශ කළේ දෙමළ ජාතික සන්ධානය තමන්ට සහය දීම ගැන ප්‍රතිචාර දක්වමිනි.

රනිල් වික්‍රමසිංහගේ කතාවෙන් අනතුරුව කතානායක කරු ජයසූරිය සභාවට දැනුම් දුන්නේ, පාර්ලිමේන්තුව දෙසැම්බර් 18 වන දා පස්වරු 1.00 දක්වා කල් තබන බවය.

"පාර්ලිමේන්තු මන්ත්‍රීවරුන් 225 ම සහය පළ කළත් රනිල් වික්‍රමසිංහට අගමැතිධුරය ලබා නොදෙන බව," ජනාධිපතිවරයා පවසන අවස්ථාවේ මෙවන් යෝජනාවක් එක්සත් ජාතික පෙරමුණ පාර්ලිමේන්තුවේ සම්මත කිරීම මෙම දේශපාලන අර්බුදය තවත් තීව්‍ර කිරීමට බොහෝ විට ඉඩකඩ තිබේ.

මේ ගැන බීබීසි සිංහල සේවය එක්සත් ජාතික පක්ෂයේ මන්ත්‍රී මංගල සමරවීරගෙන් විමසු විට ඔහු පැවසුවේ, "ව්‍යවස්ථාව අනුව ජනාධිපතිවරයාට" කටයුතු කිරීමට සිදුවනු ඇති බවය.

ජනතා විමුක්ති පෙරමුණේ විජිත හේරත් මන්ත්‍රීවරයාද පැවසුවේ පාර්ලිමේන්තුවේ බහුතරය ඇති පුද්ගලයාට අගමැති ධුරය ලබාදීම ප්‍රතික්ෂේප කිරීමට ජනාධිපතිවරයාට නොහැකි බවය.

"ජනාධිපතිතුමාට එහෙම කියන්න බැහැ. ඒක ව්‍යවස්ථා විරෝධීයි. පාර්ලිමේන්තු බහුතරය තියෙනවනම් යම් කෙනෙකුට ඔහුව පත්කිරීම ජනාධිපතිවරයාගේ වගකීම ඒක පැහැර හරින්න බැහැ," විජිත හේරත් මන්ත්‍රීවරයා කියා සිටියේය.

"මේ පක්ෂ දෙකට ම අපේ විශ්වාසය නැහැ, අපි මීට පෙර රනිල් වික්‍රමසිංහට විරුද්ධව ජන්දය ප්‍රකාශ කළා, ඒක අපිට නැවත පුන පුනා කියන්න අවශ්‍ය නැහැ, අපි ඒ ස්ථාවරයේ දිගටම ඉන්නවා," විජිත හේරත් මන්ත්‍රීවරයා වැඩිදුරටත් අදහස් දක්වමින් පැවසුවේය.

Parliament votes to back Wickremesinghe

ECONOMYNEXT - Sri Lanka parliament has supported ousted Prime Minister Ranil Wickremesinghe with with 117 legislators out of 225 voting in favour of a resolution to express confidence in him after President Maithripala Sirisena plunged the country into a crisis by appointing Mahinda Rajapaksa in his place.

The Janatha Vimukthi Peramuna which has 6 members were absent, after voting against Wickremesinghe in a vote of no confidence earlier in the year.

The JVP had voted against Rajapaksa.

President Sirisena had refused to reappoint Wickremesinghe as Prime Minister despite repeated no confidence motions against Rajapaksa.

Sri Lanka's Supreme Court has barred Rajapaksa from acting in office.

Parliament demands sacked PM is restored


AFP - Sri Lanka's legislature voted overwhelmingly Wednesday to demand the reinstatement of prime minister Ranil Wickremesinghe, as a bitter power struggle headed for a government shut down within weeks.

Members of Wickremesinghe's party and their allies voted 117-0 asking President Maithripala Sirisena to restore the status quo prior to October 26 when he dismissed his former ally.

"This resolution expressing confidence in me is a vote to defeat the coup of October 26," Wickremesinghe told parliament referring to his controversial sacking by Sirisena six weeks ago.

Sri Lanka has been trapped in a bitter power feud since the president replaced Wickremesinghe with Mahinda Rajapakse, a controversial former strongman leader who has failed to secure parliamentary support.

Parliament has twice voted against Rajapakse but he has refused to step down. Instead, Rajapakse and his allies are boycotting parliament since they do not have a majority in the 225-member assembly.

It was not immediately clear if Wednesday's resolution would be accepted by Sirisena who has vowed he will not give the job back to Wickremesinghe.

Courts have prevented Rajapakse and his disputed cabinet exercising the powers they claim until they can prove their legitimacy. A hearing by the Court of Appeal on Wednesday was put off till January 16.

Former finance minister Ravi Karunanayake said the entire public sector will come to a complete stand still from January 1 in the absence of a budget for the New Year.

"Unless this parliament approves a budget for 2019, the government will not be able to spend even one cent from January 1," Karunanayake told parliament.

Officials have expressed similar fears and urged Sirisena to resolve the crisis at the earliest. Sri Lanka's credit ratings have already been cut.

Parliament, dominated by Wickremesinghe and his allies, have also blocked the office of prime minister spending any funds.

The parliament chamber has witnessed violence in recent weeks as the power struggle dragged on, with Rajapakse loyalists throwing chilli powder at rivals and smashing furniture.

The Supreme Court announces verdict stating that the gazette notification dissolving the parliament is not in accordance with the constitution.


Sri Lanka was on the edge, ahead of the crucial Supreme Court ruling on President Maithripala Sirisena’s controversial sacking of Parliament and call for a snap election that pushed the country into unprecedented political turmoil.


As many as 13 petitions were filed against the President’s November 9 order sacking the 225-member Parliament, almost 20 months before its term was to end, and setting the election date for January 5.


The petitions have been filed by political parties including United National Party (UNP), Janatha Vimukthi Peramuna (JVP), the Tamil National Alliance (TNA), Tamil Progressive Alliance (TPA) and the All Ceylon People’s Congress.


Organisations and activists such as the Centre for Policy Alternatives (CPA), Attorney Aruna Laksiri and also a member of Elections Commission Prof. S. R. H. Hoole have also filed petitions.


The Supreme Court on November 13 had issued an interim order ruling Sirisena’s gazette notification as temporarily illegal and halted the preparations for snap polls. The hearing in the case was concluded last week as the court reserved its judgment.


The judge bench consisting of Supreme Court Justices consisting of Chief Justice Nalin Perera, Priyantha Jayawardena, Prasanna Jayawardena, Sisira de Abrew, Vijith Malalgoda, Buwaneka Aluwihare and Murdu Fernando commenced hearing the petitions on the 4th of December.


On the final day of hearing of the petitions, President’s Counsel S. Kanageswaran, representing the leader of the Tamil National Alliance (TNA) R. Sampanthan, presented submissions on behalf of the petitioners.


He stated that the impunity conferred to the President of the country, under Article 35 of the Constitution, in civil or criminal proceedings has been inhibited to a certain extent by the 19th Amendment to the Constitution.


Pointing out that the 19th Amendment to the Constitution has made provisions to file lawsuits under Fundamental Rights against the executive and administrative actions of the President, he said that the official activities of the President can be queried before the court.


Hence, the dissolution of the Parliament is also an official activity carried out by the President, it can be challenged before the court under the Fundamental Rights provisions, President’s Counsel Kanageswaran had further said.


The rest of the attorneys appearing on behalf of the petitioners also presented submissions in this regard.


The petitioners had presented submissions before the court in response to the submissions of the intermediate petitioners.


Presenting submissions before the Supreme Court on the 5th of December, the Attorney General had stated that in accordance with Article 38 (02) of the Constitution, the Supreme Court does not have the legal authority to hear these fundamental rights petitions filed against the parliamentary dissolution.


The Supreme Court last Friday (Dec. 7) concluded the hearing of the petitions filed challenging the Gazette notification dissolving the Parliament after four consecutive days of court hearings.


Meanwhile, the interim order issued by the court, suspending the Gazette notification on the dissolution of Parliament, was extended until the verdict is delivered in the case.





President Sirisena has said he will accept the Supreme Court’s ruling on the petitions filed against his gazette notification dissolving Parliament.


“I look forward to the constitutional interpretation of the Supreme Court. Whatever it may be, I will take future political decisions accordingly, to the best interest of our motherland, not to the benefit of any person, group or party,” the president tweeted on Sunday.


His remarks were apparently aimed at Wickremesinghe’s United National Party (UNP) with whom Sirisena was running the national unity government since 2015.


The partnership ended on October 26 when Sirisena fired Wickremesinghe, triggering the political standoff.


Since ousting Wickremesinghe, Sirisena has highlighted the “shortcomings” of the ex-premier in a bid to justify his sacking and dissuade his reinstatement.


The president has already said he has no intention of making Wickremesinghe prime minister again no matter what the outcome of the case.


Both Wickremesinghe and Rajapaksa claim to be the rightful prime minister. Wickremesinghe says his dismissal is invalid because he still commands a majority in Parliament.


Speaker Karu Jayasuriya has officially conveyed that the House does not recognise Rajapaksa as the legal prime minister until he proves his majority.


The United National Front (UNF) coalition led by Wickeremesinghe has moved three no-trust motions against Rajapaksa.


The motions came to be adopted after the speaker summoned Parliament, in a direct confrontation with Sirisena.

තවදුරටත් රටේ නීත්‍යානුකූල අගමැතිවරයා තමන් බව රනිල් වික්‍රමසිංහ අවධාරණය කිරීම සහ මහින්ද රාජපක්ෂ පාර්ශවයට පාර්ලිමේන්තුවේ බහුතර බලය ලබාගැනීමට නොහැකිවීමත් සමග ජනාධිපති මෛත්‍රීපාල සිරිසේන පසුගිය නොවැම්බර් 09 වන සිකුරාදා පාර්ලිමේන්තුව විසුරුවා හැරියේය.

ඉන් අනතුරුව එය නීති විරෝධී යැයි ප්‍රකාශ කරන මෙන් ඉල්ලා එක්සත් ජාතික පක්ෂය, දෙමළ ජාතික සන්ධානය, ජනතා විමුක්ති පෙරමුණ, ශ්‍රී ලංකා මුස්ලිම් කොංග්‍රසය, ශ්‍රී ලංකා මහජන කොංග්‍රසය, විකල්ප ප්‍රතිපත්ති කේන්ද්‍රය, මැතිවරණ කොමිසමේ සාමාජිකයෙකු වන මහාචාර්ය රත්නජීවන් හූල් ඇතුළු පාර්ශව 13 ක් නොවැම්බර් 12 වන දින ශ්‍රේෂ්ඨාධිකරණයට මූලික හිමිකම් පෙත්සම් ඉදිරිපත් කළහ.

එම පෙත්සම් සලකා බැලූ ශ්‍රේෂ්ඨාධිකරණය නොවැම්බර් 13 වන දින අතුරු නියෝගයක් ප්‍රකාශයට පත්කරමින් පාර්ලිමේන්තුව විසුරුවා හැරීම දෙසැම්බර් 07 වන දින දක්වා අත්හිටුවන ලද අතර, පසුව එම අතුරු නියෝගය දෙසැම්බර් 10 වන දින දක්වා දීර්ඝ කරනු ලැබ තිබිණ.
19 වෙනි ව්‍යවස්ථා සංශෝධනය

2015 අප්‍රේල් මාසයේ සම්මත කරගන්නා ලද 19 වෙනි ආණ්ඩුක්‍රම ව්‍යවස්ථා සංශෝධනයට අනුව, පාර්ලිමේන්තුව විසුරුවා හැරීම සම්බන්ධයෙන් ව්‍යවස්ථා දෙකක සඳහන් වේ.

ආණ්ඩුවක් පිහිටුවන්න ඉඩ දෙන බවට ජනාධිපතිවරයා ප්‍රකාශ කළා - නිශාන්ත මුතුහෙට්ටිගම


පාර්ලිමේන්තුවේ මන්ත්‍රිවරුන් 113 ක ගේ සහය හිමි පක්ෂයට ලබන සදුදා නව ආණ්ඩුවක් පිහිටුවීමට තමන් ඉඩ ලබා දෙන බවට ජනාධිපති මෛත්‍රිපාල සිරිසේන මහතා ප්‍රකාශ කලා යැයි පාර්ලිමේන්තු මන්ත්‍රි නිශාන්ත මුතුහෙට්ටිගම සදහන් කර සිටිනවා.

අද (13) රාත්‍රියේදී ජනාධිපතිවරයා සහ ශ්‍රී ලංකා නිදහස් පක්ෂ පාර්ලිමේන්තු මන්ත්‍රිවරුන් අතර පැවති සාකච්ජාවේදී මේ බව ජනාධිපතිවරයා ප්‍රකාශ කල බවයි මන්ත්‍රිවරයා මෙහිදී කියා සිටියේ.

ශ්‍රී ලංකා නිදහස් පක්ෂය ප්‍රමුඛ එක්සත් ජනතා නිදහස් සන්ධානය ලබන සදුදා වන විට පාර්ලිමේන්තුවේ මන්ත්‍රිවරුන් 113 ක ගේ බලය පෙන්වන බවට මෙහිදී මන්ත්‍රිවරයා වැඩිදුරටත් කියා සිටියා.

මන්ත්‍රිවරුන් 117 දෙනෙක් ගේ සහය රනිල් වික්‍රමසිංහ මහතාට හිමිවී ඇති බවට ඊයේ (12) පාර්ලිමෙන්තුවේ දී තහවුරුවූ බැවින් මන්ත්‍රිවරු 113 දෙනෙක් ගේ සහය ලබා ගන්නේ කෙසේද යන්න පිළිබදව නෙත් නිවුස් සිදු කල විමසීමේදී නිශාන්ත මුතුහෙට්ටිගම මන්ත්‍රිවරයා කියා සිටියේ රනිල් වික්‍රමසිංහ මහතාට පාර්ලිමේන්තුවේ ඇත්තේ මන්ත්‍රිවරුන් 103ක් පමණක් බවයි.
