First draft resolution on Lanka at UNHRC

A first draft of the US sponsored resolution on Sri Lanka at the UN Human Rights Council calling for an investigation into alleged abuses by both parties to the conflict to be led by the Office of the High Commissioner for Human Rights (OHCHR) Navi Pillay has been tabled.

The draft resolution which was reportedly tabled yesterday titled “Promoting reconciliation, accountability, and human rights in Sri Lanka” has been submitted by the United States, United Kingdom of Great Britain and Northern Ireland, Montenegro, FYR of Macedonia, and Mauritius

It requested the Office of the High Commissioner to assess progress toward accountability and reconciliation, monitor relevant national processes and to investigate alleged violations and abuses of human rights and related crimes by both parties in Sri Lanka.

The Resolution HRC 25/1 welcomes and acknowledges the progress made by the Government of Sri Lanka in rebuilding, infrastructure, demining and resettling the majority of internally displaced persons.

However, the resolution notes that considerable work lies ahead in the areas of justice, reconciliation, demilitarization, and the resumption of livelihoods, and stressing the importance of the full participation of local populations, including representatives of civil society and minorities in the efforts.

The resolution expressed alarm at the rapid rise in violence and discrimination on the basis of religion or belief, particularly against members of religious minority groups.

It called upon the government to fulfill its public commitments, including the devolution of political authority which is integral to reconciliation and the full enjoyment of human rights by all members of population.

The resolution reiterated that the national plan of action established to implement recommendations of the Lessons Learnt and Reconciliation Commission (LLRC) does not adequately address all of the findings and recommendations of the LLRC asked the government to broaden the scope of the plan.

It called upon the Sri Lankan government to cooperate with the Office of the High Commissioner concerning the implementation of the resolution.

Still the resolution has not been tabled. This was confirmed by Ada Derana News Director. That is the reason they did not send a SMS Alert. Website should be corrected soon.

The Tamil Diaspora has criticized the US draft resolution on Sri Lanka, submitted to the UN Human Rights Council yesterday, saying it fell short of expectations.

The British Tamils Forum (BTF), a London based Diaspora group which has been having several discussions with the Government and opposition in UK on the Sri Lankan issue, said the resolution effectively calls for more of the same as past resolution.

BTF says the resolution requests another update by the Human Rights Commissioner in a year’s time and makes another call on Sri Lanka to launch a credible domestic inquiry, despite the Human Rights Commissioner herself declaring that Sri Lanka has no political will to investigate itself.

“Five years on from the terrible massacres of 2009, the Tamil people have been told to put up with another year of lost land, lost people, further curtailment of rights, physical and sexual abuse. A state that is moving in an increasingly authoritarian direction, according to the Human Rights High Commissioner, has inexplicably been given yet more time and space,” BTF said.

It said that while the resolution acknowledges the culture of “intimidation and retaliation against civil society members including those who met the High Commissioner during her visit” it fails to recognize that witnesses and evidence that the High Commissioner is yet to see are disappearing every day.

“The Sri Lankan state now has even more time to complete its programme of destroying evidence and eliminating witnesses to the crimes committed. The recently set up commission to inquire into “disappearances” demonstrates what can be expected from a local mechanism: relatives who lodged details of their missing ones were visited by Sri Lankan security forces and threatened with serious consequences if they did not withdraw their claims,” BTF added.

The British Tamils Forum has been consistent and persistent in its call for an International Independent Investigation into war crimes, crimes against humanity and genocide – indeed, this is the collective call of all Tamil organisations across the world.

BTF says UK Prime Minister David Cameron and his government had given strong reassurances that they will ensure an international independent investigation takes place in Sri Lanka. Several other world statesmen have echoed these calls. In the past week there have been unambiguous calls for an immediate independent international investigation by several prominent NGOs, by the current UN Human Rights Commissioner, Navaneethem Pillay, her predecessor and current President of the International Crisis Group, Louise Arbour and the Christian churches in the North and East of Sri Lanka.

“In this context, the draft text released yesterday is a painful slap in the face of all those victims who still await justice and a kick in the back for the weary Tamils of North and East Sri Lanka, who are trying to get on with their everyday lives in the face of escalating colonisation and militarisation of their lands. Furthermore, there is no doubt that such a meaningless resolution would undermine the Tamil people’s belief that engagement with the international community can serve any purpose in their decades-long struggle for peace, freedom and rights on the island of Sri Lanka,” BTF added. Its politics there too as usual.

The US & UK are after tamil minority votes but do not want to alienate Sri Lanka, a strategic location in this region, as they need friends especially when USSR is flexing its mussel for supremacy.

Tamil diapora should understand this reality, adjust their policy and corporate with the Govt. Otherwise, they too will die a natural death.

Govt too should be flexible and allieviate their fears, provide some space for them to participate in the govenance not only in the North & East but in national politics.

මේ තත්ත්වය යටතේ නවී පිල්ලේ මහා කොමසාරිස්වරිය ශ්‍රී ලංකාව සම්බන්ධයෙන් ඉදිරිපත් කළ "දේශපාලන ස්වරූපයක් ගත් ආක්‍රමණශීලී ආකාරයේ වාර්තාව" ශ්‍රී ලංකා ආණ්ඩුව ප්‍රතික්ෂේප කරන බව ඔහු වැඩිදුරටත් කියා සිටියේය.

Sri Lanka has continued its proactive relationship with the UNHRC despite being the target of country-specific actions taken by the council at the behest of a few member states, External Affairs Minister Prof. G.L. Peiris stated while addressing the 25th UNHRC sessions being held in Geneva.

The Minister pointed out to the council that some countries were exploiting human rights for political purposes while highlighting the disproportionate efforts to implement country specific resolutions while conveniently ignoring other pressing issues.

“The disproportionate attention being paid to country specific action in the council selectively targets some countries while situations, human rights violations and restrictive practices in other parts of the world that warrant more urgent and immediate attention and action remain conveniently ignored as it exploits human rights for political purposes. Regrettably a similar pattern is evident in the case of continued action on Sri Lanka in this council”, he stated.

He also shared Sri Lanka’s deep concern for the lack of financial independence of the OHCHR which has lead to the erosion of the independence of its overall functioning while stressing the importance of the UNHRC remaining a credible and independent arbiter in dealing with global human rights situations.

Prof. Pieris said that economic, social and cultural rights need to gain the same level of emphasis and legitimacy as civil and political rights which are at the core of sustainable development.

He claimed that any objective observer would agree that Sri Lanka’s achievements would match or surpass that of any country coming out of a similar experience while briefing the council on several efforts by the government to address the many pressing issues concerning resettlement, demining and reconciliation.

He highlighted a Special Land Circular which aims to grant legal ownership of land to those being resettled while also informing the council of the government’s ten-year plan to achieve a trilingual Sri Lanka with bilingual programmes already being implemented for public servants.

The External Affairs Minister also spoke briefly of the visit of UN Human Rights High Commissioner, Navi Pillay and the Commonwealth Heads of Government Meeting (CHOGM) held in Sri Lanka last year.

Sri Lanka remains committed to the council and its mechanisms including special procedures while Sri Lanka continues to submit its periodic reports to its treaty bodies, he added.

He stressed that there was no acknowledgement of the very tangible progress made by Sri Lanka while country-specific action against the country showed a lack of sensitivity in dealing with delicate situations which expose the unfair and biased manner in which issues pertaining to Sri Lanka have been addressed.

The government of Sri Lanka categorically rejects the High Commissioner’s report and will share its observations on the substantive content of the report, he claimed. He described the recommendations contained in the report as being arbitrary, intrusive and of a political nature.

He also added that, references made within the council welcoming the High Commissioner’s report was regrettable as the report was based on baseless and questionable material including what had been processed outside the UN framework.

The report and those who exalt its virtues only seek to inflict harm on the reconciliation process by bringing about a polarization of Sri Lankan society, he stated in closing.

Sumanthiran didn’t let me speak in Geneva – Anandi

TNA’s Northern Provincial Council member Anandi Saseedaran today strongly criticized TNA Parliamentarian M.A. Sumanthiran for not allowing her to address the international community as part of the Tamil party’s delegation to Geneva.
Addressing a press conference in Jaffna today, she stated that the Tamil people had placed their trust on the resolution moved at the UN Human Rights Council in Geneva, calling for an investigation into alleged war crimes in Sri Lanka.
However, that trust has been now been broken and the Tamil people are disappointed by this, she said.
Saseedaran stated that the Tamil National Alliance (TNA) had sent a delegation of representatives to Geneva, in order to brief the international community ahead of the 22nd session of the UNHRC on the prevailing situation in the country, and that she too was part of it.
She stated that on February 13 they met and spoke with representatives from 18 different nations in the city in Switzerland.
However, she says, that MP Sumanthiran prevented her from making any statements and that he too avoided speaking about an international probe into allegation of human rights in the final stages of the war.
Saseedaran said that the TNA MP had asked her to refrain from making any statement or speaking to any member of the international community, saying that she would be seen as a LTTE sympathizer as she is the wife of former LTTE Trincomalee political head S. Elilan.
He asked me to let him do all the talking, she told reporters.
Saseedaran further charged that Sumanthiran did not speak about an “international investigation” or about the “genocide” in Sri Lanka.
The Northern Provincial Councilor said she would have never gone to Geneva as part of the TNA delegation had she known that she would only be a mute spectator.

My view-As Rev.Malcom Ranjith said, this is our internal problem. Solution/ answer should come internally. But now outsides has taken over our problem & they are handling it to fulfilling their political game. We both should understand this reality.

but this is long time process , if we see the history it is true over 20 years taken to punish for war crime. and this is not against to Sri Lanka it should be against to somebody , So nothing happen until they are in power.

Remember, the two proponents of the resolution, namely USA & UK, too have skeletons in their bags but want us to dance to their tunes. They should leave us alone so that we can solve our problems amicably.
