Parliament sacking unconstitutional, arbitrary: Supreme Court

ECONOMYNEXT - Sri Lanka's highest court has overturned sacking of Parliament confirming an earlier temporary order and halted a general election, delivering a blow to President Maithripala Sirisena in an ongoing political crisis.

Chief Justice Nalin Perera delivered the judgment. The decision was unanimous but with one judge delivering giving different reasons for the decision.

Chief Justice Perera said President Sirisena's proclamation outside the legal limits and it violated the rights of members of parliament.

There was arbitrary exercise of power, he said.

Justice Sisira de Abrew delivering a concurring judgment said according to the constitution, the President cannot dissolve parliament until the lapse of 4.5 years.

The proclamation dissolving the parliament was null and void. It holds no power in law, he said.

Sri Lanka's United National Party officials said they expected the President to appoint Wickremesinghe as Prime Minister.

President Maithripala Sirisena appointed ex-President Mahinda Rajapaksa as Prime Minister on October 26 sacking incumbent Ranil Wickremesinghe in a contested move, plunging Sri Lanka into an economic and political crisis which is separately challenged in court.

Rajapaksa however failed to gather a 113 majority to show the confidence of parliament. President Sirisena said in a video interview, Rajapaksa was unable to buy over enough legislators as the cost rose to as much 500 million rupees apiece.

President Sirisena then sacked the parliament and called for fresh elections. The Supreme Court suspended the decisions pending a final order.

President Sirisena has refused to appoint Wickremesinghe as PM, despite 117 legislators voting to support him and Rajapaksa suffering multiple no confidence motions.

UNF expects Wickremesinghe re-appointment, JVP wants 'coup' leaders punished

ECONOMYNEXT - Sri Lanka's United National Front expects appoint Ranil Wickremesinghe to be re-appointed Prime Minister while their opponents said a decision will be taken tonight after the Supreme Court reversed a sacking of parliament by President Maithripala Sirisena.

"Sri Lanka has a strong democratic traditions, illegitimate acts by the executive or or parliament cannot be sustained over a long period of time," Eran Wickremeratne, from the United National Party said.

"This is a victory for the people."

Wickremeratne said he expected the President to re-appoint Wickremesinghe and form a government.

Deputy UNP leader Sajith Premadasa said Sri Lanka's judiciary had shown its independence and served as an effective check on the executive.

President Maithripala Sirisena plunged Sri Lanka into a political and economic crisis appointing Mahinda Rajapaksa as Prime Minister on October 26, sacking Wickremesinghe and calling for fresh elections.

The Supreme Court ruled that President Sirisena had no power to dissolve parliament until the lapse of 4.5 years as set out in an amendment to Sri Lanka's constitution in 2015.

"The overall intention of the 19th amendment to reduce the power of the executive has been vindicated," Jayampathy Wickremeratne, constitutional lawyer and UNP legilslator who helped draw up the amendment said.

Sri Lanka's Court of Appeal has barred Rajapaksa from acting as Prime Minister in a separate decision.

Rajapaksa's Sri Lanka Podujana Party, a breakaway faction of President Sirisena's Sri Lanka Freedom Party is pressing for general elections.

Rajpaksa's son Namal told reporters they did not agree with the Supreme Court verdict

"But there is no higher court for us to go to," he said. "We will take a decision as a group."

Another ally Dinesh Gunewardene, said Rajapaksa would take a decision on the future course of action tonight.

"The Supreme court gave a decision against us," he said. "In the end people will decide whether there is a parliament or not. Our democnary is that we need election, UNP's democracy is not to have elections.

"Mahinda Rajapaksa will decide tonight the way forward."

Sri Lanka's Marxist Janatha Vimukthi Peramuna said the current parliament had a limited life and it must take action to punish those involved in the coup.

Parliament must bring in a special law to punish those involved in this coup, he said. But enacting retrospective legislation is considered an illiberal act which is against natural justice.

At a late night meeting, President Sirisena had reportedly instisted again that he will not make Wickremesinghe Prime Minister and had also asked members of his United National People's Alliance not to join him. (Colombo/Nov14/2018)

Sri Lanka political brinkmanship continues amid court battle

ECONOMYNEXT - Sri Lanka's President Maithripala Sirisena has asked members of his United National People's Alliance not to join any possible administration of the United National Front, with another case pending at the Supreme Court later today.

A court presided by Justice Eva Wanasundera is due to take up an application for special leave for appeal filed my Mahinda Rajapaksa after the Court of Appeal issued a writ of quo warranto questioning his right to be Prime Minister and suspended him from acting in the post.

The Supreme Court could grant leave for appeal and could also issue a stay order on the Court of Appeal decision at the same time, allowing Rajapaksa to continue in office, pending a final hearing of the appeal.

Lawyers for the United National Party have asked for a fuller bench to hear the case and also filed motion against Wanasundera saying she has admitted close friendship with Rajapaksa in a newspaper interview.

Court vacations will start at the end of this week.

Lakshman Yapa Abeywardene, was quoted in the Island newspaper as saying that President Sirisena was insisting that he would not work with Wickremesinghe.

He had also asked UPFA members not to join any UNF administration.

Some of his members have already asked to join any future UNF administration, political sources said.

Sri Lanka is entering 2019 with no budget or vote on account to run the government in the new year, with a disputed cabinet headed by Rajapaksa not having a parliamentary majority to pass any law.

Supreme Court hears Rajapaksa appeal against interim order

ECONOMYNEXT – A three-member bench of Sri Lanka's Supreme Court is hearing an appeal by former president Mahinda Rajapaksa against an interim court order barring him from acting as Prime Minister.

The petitioners had requested a seven member bench, raising concerns about the impartiality of controversial Justice Eva Wanasundera who has been quoted in a newspaper in 2014 saying that she has a close friendship with Rajapaksa.

A three judge bench made up of justices Eva Wanasundera, Buvenaka Aluvihare and Vijith Kumara Malalgoda took up the appeal Friday.

Counsel for Rajapaksa presented arguments saying the interim Appeal Court order made no sense and was illogical and questioning whether a no-confidence motion against Rajapaksa in parliament was actually carried through.

The court hearing, to decide whether to grant Rajapaksa special leave to appeal against the interim order, will be resumed after a break for lunch.

Court rules against Sri Lanka president, impeachment edges closer

AFP - Sri Lanka's Supreme Court opened the way for potential impeachment proceedings against the president on Thursday, ruling that he broke the law by dissolving parliament last month.

The verdict is a major blow to Maithripala Sirisena, seven weeks into a political crisis in the Indian Ocean island nation that has sparked alarm abroad and concern over its finances.

The seven-judge bench unanimously agreed that Sirisena violated the constitution when he dissolved parliament last month and called a snap election nearly two years ahead of schedule.

"I make order that the November 9 Gazette (decree) sacking parliament... has no force or effect in law and declare its operation illegal," Chief Justice Nalin Perera said as he delivered the landmark judgement to a packed courtroom.

Sacked prime minister Ranil Wickremesinghe's party had said it would await the outcome of Thursday's decision before deciding whether to open impeachment proceedings.

Sirisena triggered the unprecedented political crisis on October 26 when he fired Wickremesinghe and appointed contentious former strongman Mahinda Rajapakse in his place.

There was no immediate comment from either Sirisena or Rajapakse. However, Rajapakse's legislator son, Namal, told reporters outside the court house that they did not agree with the verdict.

"We do not agree with the decision of the court, but we do not have a higher court to appeal to," he said.

- 'Coup' -

The leftist JVP, or the People's Liberation Front, said the sacking of the prime minister in October was a "coup orchestrated by Sirisena and Rajapakse" and called for a resolution in parliament to bring them to justice.

"This first thing this (restored) parliament should is to investigate the coup and bring both the president and his illegal prime minister to justice," JVP leader Anura Kumara Dissanayake said.

Wickremesinghe's United National Party (UNP) welcomed the verdict as a victory for democracy.

"As a country we have to be joyful that we have an independent judiciary that acted as a check on an errant executive," UNP deputy leader Sajith Premadasa said.

Sirisena dissolved parliament on November 9 when Rajapakse, the man he appointed as prime minister, was unable to prove a majority in the 225-member assembly.

Constitutional provisions were clear that he could not dissolve the legislature until it completes four and a half years out of its five-year term, which ends in August 2020.

Four days later after parliament was sacked, the Supreme Court issued an interim ruling suspending Sirisena's decree and restoring parliament, which almost immediately passed a no-confidence motion against Rajapakse, the purported premier.

Wickremesinghe's party and their allies command a majority in parliament.

On Wednesday, the legislature voted overwhelmingly to demand the reinstatement of Wickremesinghe with the power struggle just weeks away from a government shutdown.

Members of Wickremesinghe's party and their allies voted 117-0 asking Sirisena to reverse his October 26 dismissal of his former ally.

However, Sirisena has vowed he will not reinstate Wickremesinghe.

Courts have also prevented Rajapakse and his disputed cabinet exercising power until they can prove their legitimacy. A hearing by the Court of Appeal on Wednesday was put off until January 16.

Former finance minister Ravi Karunanayake said the entire public sector will come to a complete standstill from January 1 in the absence of a budget for the New Year.

Officials have expressed similar fears and urged Sirisena to resolve the crisis urgently. Sri Lanka's credit ratings have already been cut.

Sri Lanka's PM faces fresh trouble

ECONOMYNEXT - Sri Lanka's reinstated Prime Minister Ranil Wickremesinghe marked his first day back in office Monday with a hostile president resisting his nominations to a new cabinet.

Party officials said Wickremesinghe was battling to form a government as Maithripala Sirisena insisted that he wanted to retain media and the law-and-order portfolios. Wickremesinghe's United National Party (UNP) was against giving the key portfolios to Sirisena.

"The President wants to keep law-and-order and media portfolios, but the prime minister disagrees," a party official said adding that the tug-of-war led to the delay in forming a cabinet.

Sirisena reluctantly gave Wickremesinghe his old job back on Sunday, but made it clear that he will have a close tab on the administration signalling an uneasy cohabitation arrangement.

A new cabinet was to be named Monday, but there were no signs of finalising a list of ministers 24 hours after Wickremesinghe was sworn.

There was no immediate comment from the president's office, but shortly after swearing-in Wickremesinghe, the
president launched a scathing attack on him, accusing his previous administration of corruption.

"I still believe that I should not have made Ranil Wickremesinghe the prime minister, but I bow to the wishes of the majority in parliament," Sirisena said.

"But, I don't know how far we will succeed in fulfilling the wishes of our people."

Meanwhile, the UNP staged a major rally at Galle Face on Monday afternoon to mark the reinstatement of Wickremesinghe after the judiciary and the legislature ruled against the power grab of Sirisena-Rajapaksa combine. (COLOMBO, December 17, 2018)

President says made Ranil Premier to respect democracy

ECONOMYNEXT - Sri Lanka's President Maithripala Sirisena said he re-appointed Ranil Wickremesinghe Prime Minister out of respect for democracy and parliamentary tradition though his personally opposed to it.

President Sirisena had said he will not make Ranil the PM even if 225 members asked him to do so.

He was still of the same opinion but, as a leader who respected democracy and parliamentary traditions, he had invited Wickremesinghe to be the PM, President Sirisena had told United National Party legislators shortly after swearing in Wickremesinghe.

President Sirisena, had said there were statements made that he would be impeached, but he had taken the decisions to dissolve parliament in the best interests and believing that it should be up to the voters to decide.

He said he intended to take forward the government without conflicts, as conflicts made the country go backwards.

UNP Deputy Leader Sajith Premadasa had said that his party had no intention of impeaching the President and it was the intention of his party to work in co-operation with the President. (Colombo/Nov16/2018)

Wickremesinghe warned against 2015 repeat, cronyism

ECONOMYNEXT - Pro-democracy activists who helped defeat a constitutional coup against United National Party leader Ranil Wickremesinghe are warning against a repeat of his 2015 actions.

Wickremesinghe’s cronies were appointed to key posts and principles of promised good governance were cynically violated by the party's old guard and money men.

Janatha Vimukthi Peramuna leader Anura Kumara Dissanayake warned Wickremesinghe against trying to crawl through constitutional loopholes to expand any future cabinet to 45 from a ceiling of 30 set by the 19th amendment to the constitution.

"President Sirisena tried to crawl through a constitutional loophole. Mahinda Rajapaksa tried to crawl through a constitutional loophole," Dissanayake told a political rally, after courts ruled against the President and Rajapaksa.

"We hear that Wickremesinghe is also trying out crawl through the constitution by trying to define a new administration as a 'national government' claiming a Sri Lanka Muslim Congress legislator as a separate party, so that he can have 45 ministers.

"We warn him that we will bring him down if he tries to do that."

Wickremesinghe spent most of the early part of his rule mired in a so-called bond-scam, trying to protect his pal, Arjuna Mahendran, dragging down the party and taking several legislators with him, squandering political capital, which could have been used to push through a new constitution or economic reform, critics say.

"If Ravi Karunanayake is given ANY ministerial portfolio, you will be answerable to us, Ranil Wickremesinghe," said Sharmini Seresinghe, a vocal activist who also helped organize a rally against the unconsitutional actions of President Maithripala Sirisena and Mahinda Rajapaksa.

"From here on, we are NOT going to take things sitting down. We the citizens of Sri Lanka have remained patient and silent for too long. NOT ANYMORE !!!"

Wickremesinghe had already created a precedent by bringing back Tilak Marapone, who was forced to step down amid a public outcry over his defence of Avant Garde company accused of embezzlement under the Rajapaksa regime.

To his credit, Wickremesinghe did not try to censor the internet, though Maithripala Sirisena blocked Lankaenews.com, a political news website.

The very tweeters who criticized Wickremesinghe and his unpopular cronies, came out to support him when he was ousted unconstitutionally.

Chandra Jayaratne, a governance activist, said Sunday, no person who were associated or suspected to be associated with any acts of corruption or violating law should be made ministers, secretaries or senior positions in state agencies.

"All politicians, political appointees, law enforcement officer leaders and others who placed hurdles in the Effective conduct of Investigations and Unbiased & Just Law Enforcement and Judicial actions should be sidelined, he said.

Wickremesinghe's close associates as well as President Sirisena are alleged to have protected corrupts persons of the Rajapaksa regime.

One time law law order minister minister Sagala Ratnayake traded accusations with President Sirisena, threatening to reveal how investigations were blocked.

"As a responsible Cabinet minister, I have never spoken in public about instances in which the @MaithripalaS interfered with high-profile investigations," he said in a twitter.com post.

"But if these wild allegations continue, I will be forced to divulge details on who interfered, when, where and how. #lka"

Wickremesinghe entered the main hall of his Temple Trees Saturday and spoke a few words to hundreds of supporters that were waiting to hear him and walked off the stage, without coming down to talk to them or pose for selfies like Mahinda Rajapaksa would have done.

That Wickremesinghe will alienate his new found supporters is a widely held belief.

UNP to form broad alliance, push to abolish presidency

ECONOMYNEXT - Sri Lanka's freshly re-appointed Prime Minister Ranil Wickremesinghe said a broad alliance will be formed to abolish the presidency amid friction with President Maithripala Sirisena in appointing ministers.

Wickremesinghe said an alliance style National Democratic Front will be set up with the aim of abolishing the executive presidency and strengthen institutions at a large party rally in Colombo, where supporters were brought in from around the country.

He said no third party can be depended to abolish the executive presidency.

Wickremesinghe said institutions will also be strengthened.

Wickremesinghe's United National Party and Sri Lanka Freedom Party has shifting positions on abolishing the Presidency while others like the Janatha Vimukthi Peramuna has been firm in its call.

The 19th amendment to the constitution pushed for by civil activists have now strengthened the independence of the judiciary.

Wickremesinghe is in the process of forming a cabinet which has to be appointed by President Sirisena. President Sirisena has reportedly told members of his party that he will not give them appointments if they join the new cabient.

President's party seeks to be official opposition

ECONOMYNEXT - Sri Lanka's President Maithripala Sirisena's United National People's Alliance will make a formal request to make Mahinda Rajapaksa the leader of the opposition, party representatives said spelling more trouble for Prime Minister Wickremesinghe.

UPFA legislator Chandima Weerakkody said 101 members of the party's parliamentary group had decided to make a formal request to Speaker Karu Jayasuriya shortly after a meeting with President Sirisena.

The move will unseat Tamil National Alliance chief R Sambanthan from the leader of the opposition post.

Parliament is due to meet later today.

Udaya Gammanpila, another legislator said 101 members of the UPFA had decided to act together and be a strong unified group.

Until a political crisis erupted on October 26, a section of the UPFA had broken away and were with Rajapaksa while the rest was with President Sirisena in a coalition administration with Wickremesinghe's United National Front.

Rajapaksa and several others had said during the crisis that they gained membership of the Sri Lanka Podujana Party, formally leaving the UPFA alliance, which left then in danger of losing their seats if the party decided to take action.

However Rajapsaksa's brother was quoted in the media as saying that while that there was only a membership of application. Some however had tweeted their membership certificates.

US eager to work with restored Sri Lanka PM

AFP - The United States on Monday praised the restoration of Sri Lankan Prime Minister Ranil Wickremesinghe -- controversially replaced by a former strongman in October -- and voiced eagerness to work with him.

"We are pleased that the leadership in Sri Lanka has resolved the political crisis of the past several weeks in accordance with constitutional norms and the rule of law," State Department spokesman Robert Palladino said.

"Sri Lanka is a valued partner in the Indo-Pacific, and we look forward to engaging with Prime Minister Wickremesinghe and his cabinet to advance cooperation on bilateral and regional issues of common interest," he said.

President Maithripala Sirisena in October abruptly sacked his onetime ally Wickremesinghe and replaced him with Mahinda Rajapaksa, a former strongman who had defiantly refused international calls for accountability over the bloody end of the decades-old Tamil Tiger insurgency.

Wickremesinghe's dismissal sparked an outcry at home and abroad, with his allies saying that China -- which forged a close economic relationship with Rajapakse -- was involved, a claim denied by Beijing.

President's party loses three members to Ranil

ECONOMYNEXT - Three members of President Maithripala Sirisena's party crossed over to Prime Minister Ranil Wickremesinghe's side on Tuesday as a cabinet of ministers is due to be named in a administration that seems to be at loggerheads.

United People's Freedom Alliance members Indika Bandaranaika, Vjith Vjithamuni Soysa, Lakshman Seneviratne crossed over, shortly after colleague Udaya Gammanpila said all 101 members of the party decided to get together a strong force.

Speaker Karu Jayasuriya recognized Mahinda Rajapaksa as the leader of the opposition Tuesday, saying the UPFA was no longer in the government after it quit the coalition.

Other legislators raised objections saying Rajapaksa and several others were 'strangers' in the house after they publicly joined the newly created Sri Lanka Podujana Party.

Mahinda Rajapaksa named Sri Lanka opposition leader amid objections

ECONOMYNEXT - Speaker Karu Jayasuriya said he recognized Mahinda Rajapaksa as the leader of opposition amid calls for a select committee to examine whether he was still a member of parliament, following alleged joining of another party.

Jayasuriya said the United People's Freedom Alliance of President Maithripala Sirisena was now the largest opposition party now that the party was no longer in the ruling coalition.

United National Party legislator Lakshman Kiriella said there were 'strangers' in the house as some members of President Maithripala Sirisena's United National People's Alliance, constituent Sri Lanka Freedom Party had left the party publicly.

Kirella was made the leader of the house.

M A Sumanthiran of the Tamil National Alliance said a select committee of parliament should go into the matter and asked Speaker Jayasuriya to defer the decision.

Sumanthiran said the UPFA could not be the opposition since its leader President Sirisena was a member of the government.

Speaker asked him to submit a written request and he would give a decision on Friday.

Udaya Gammanpila said there were precedents with Chandrika Kumaratunga and on two other occasions the leader of the opposition being from the President's party.

Kiriella responded and said President Kumaratunga did not hold a portfolio.

Battles over attempt to form new Sri Lanka cabinet

ECONOMYNEXT - Sri Lanka's United National Front has to trim ministers down to 30 from the 33 in the last coalition administration, as negotiations are underway with a hostile President who wants police and media, political sources said.

At a meeting of the parliamentary group Tuesday morning UNF Leader Ranil Wickremesinghe has called for volunteers to step down.

Malik Samarawickreme, Rishard Bathiudeen and Mano Ganesan had offered to step down, political sources said.

But legislators Eran Wickremeratne and Harsha de Silva had opposed the resignation of Bathiudeen and Ganeshan saying members of the UNF should step down. Fellow legislators had approved the suggestion by thumping on tables, political sources said.

Legislator Navin Dissanayake had said that the UNP leader should not be pushed against the wall in making decisions.

There have also been suggestions to drop national list nominees.

Deputy Leader Sajith Premadasa had suggested that 30 capable (daksha) ministers be appointed which will have public credibility.

Wickremesinghe sidelined younger members in 2015 and appointed party seniors and so-called cronies who then undermined the credibility of the new administration.

Wickremesinghe is also battling with President Sirisena who wants to retain the police and media. Political sources say there may be deal made to share some state media institutions.

Wickremesinghe was expected to hand over a list of nominees to President Sirisena Tuesday so that a new cabinet could quickly approve a vote on account for approval by parliament.

Political analysts say the old guard of the UNP as well as other parties have a 1980s mindset where there is a belief that the leadership can get away with anything counting on a collective amnesia, but many members of the voting public are no longer partisan and seems to be a little ahead of them.

Most countries have progressed when the urban intelligentsia understands that the armed state has to be restrained by constitution and strong institutions for citizen's freedom, justice and equality to blossom. (Colombo/Dec18/2018)
