Sacking of Sri Lanka parliament illegal: commissioner

ECONOMYNEXT – Sri Lanka’s independent Election Commission believes that President Maithripala Sirisena calling parliamentary elections nearly two years ahead of schedule was illegal and unconstitutional, a commissioner told the Supreme Court Monday.

Ratnajeevan Hoole in his five-page petition to the court said that all three of the commissioner agreed that the President Sirisena’s proclamation dissolving parliament and calling a snap election was illegal.

“However, the other two commissioners expressed the view that the Commission should proceed with preparations for the conducting of the election irrespective of the legality of the proclamation,” Hoole said.

He refused to sign an order conferring powers on the Commissioner General of Elections to start the process because he felt strongly that they should not act on the basis of an illegal and unconstitutional proclamation.

“As a member of the Elections Commission he is required to be independent and impartial and to act according to law and as such he is required to take informed decisions on matters and taking decisions on legality and illegality of matters do not compromise his independence or impartiality,” Hoole’s lawyer said in the petition on his behalf.

He cited a Supreme Court decision which slapped strictures on the then elections commissioner Dayananda Dissanayake for obeying an illegal order of then president Chandrika Kumaratunga.

The Supreme Court at the time had told Dissanayake that he should have sought judicial orders before carrying out illegal directives of the executive.

“While I appreciate the difficult situation in which he was, nevertheless it is necessary to remember that the constitution assures him (Dissanayake) independence so that he may fearlessly insist on due compliance with the law in regard to all aspects of elections – even if necessary by instituting appropriate legal proceedings in order to obtain judicial orders,” according to the judgement of a three-judge bench headed by chief justice G. P. S de Silva in case SC FR 509/98

Hoole argued that Sirisena’s actions were unconstitutional, illegal and was against the people of Sri Lanka and hence demanded the restoration of status quo prevailing prior to October 26.

Hoole’s position that the president’s actions were against the constitution strengthens the argument of 10 other petitions seeking a declaration against Sirisena’s controversial move of sacking Ranil Wickremesinghe as Prime Minister on October 26 and appointing Mahinda Rajapaksa in his place.

The court will have to decide if it will grant leave to proceed to the petitioner to take up the cases for hearing. The court is also asked to decide on interim relief by way of a stay order against the elections commissioner general against making preparations to hold a vote on January 5 as decreed by Sirisena.

They also want the president’s proclamation suspending parliament declared invalid so that the assembly could continue to function and decide on who enjoys a majority in the 225-member assembly. (COLOMBO, November 12, 2018)

Supreme Court suspends dissolution of parliament

ECONOMYNEXT - Sri Lanka's Supreme Court has suspended the dissolution of parliament by President Maithripala Sirisena, granting interim relief, lawyers said.

The gazette has been suspended till December 07 in interim relief.

A three judge bench headed by Chief Justice heard petitions from several parties.

Lawyer M Sumanthiran said as a result of the case Parliament will meet tomorrow at 10.00 am.


The court also granted leave to proceed and will hear the case in the first week of December.

Supreme Court restores sacked parliament

AFP - Sri Lanka's Supreme Court on Tuesday overruled President Maithripala Sirisena's dissolution of parliament and ordered a halt to preparations for snap elections next year.

The Indian Ocean island has been gripped by a constitutional crisis since Sirisena sacked prime minister Ranil Wickremesinghe on October 26 and replaced him with former strongman president Mahinda Rajapakse.

Wickremesinghe's party led the petitions against the dissolution and the three-judge bench, headed by the Chief Justice Nalin Perera, read out the decision to a packed court guarded by hundreds of heavily armed police and commandos.

The court suspended a proclamation issued by Sirisena on Friday sacking the legislature and calling for elections on January 5.

The ruling means parliament could go ahead with a vote to test if Sirisena's controversial nominee is able to summon a majority in the 225-member assembly and force Wickremesinghe from office.

The court also ordered the independent Elections Commission to halt preparations for the January 5 vote.

Speaker hails Sri Lanka judiciary, asks officials public to follow rulings, Parliament

ECONOMYNEXT - Sri Lanka's Speaker, Karu Jayasuriya has asked members to convene to determine the legitimacy of a government and asked the public and officials to abide by the decisions of court and parliament after courts suspended a sacking of the Parliament by President Maithripala Sirisena.

"After several days of political uncertainty, the public can take pride in our judiciary, which has risen to the occasion and treated this matter of grave national importance with due urgency and deliberation," Speaker Jayasuriya said in a statement.

"Parliament must now perform its role by allowing the elected representatives of the people to reach a determination on the legitimacy of their government.

"I urge the public to find comfort in the day's events and to share my confidence in our elected representatives.

:It is important that the general public and especially persons in positions of responsibility conduct themselves in a calm and dignified manner in order to avoid unnecessary provocation and instability.

"I ask all Sri Lankans to peacefully accept the determinations of the judiciary and Parliament."

Over the last two days, The Supreme Court of the Republic of Sri Lanka heard arguments in several petitions challenging the 9th November 2018 Proclamation that purported to dissolve the 8th Parliament of Sri Lanka. Earlier this evening, the Supreme Court made interim order suspending until 7th December 2018 the operation of Extraordinary Gazette Notification Number 2096/70 by which the President sought to dissolve Parliament.

As this order by The Supreme Court renders the Gazette Notification ineffective, Parliament is bound by the previous Extraordinary Gazette Notification Number 2095/50 dated 4th November 2018 by which the President summoned Parliament to convene at 10:00 AM on 14th November 2018.

I have discussed this development with the Secretary-General of Parliament and several party leaders. A party leader's meeting will be held in the Parliament Complex at 8:30 AM tomorrow, 14th November 2018.

Thereafter, Parliament shall convene at the Chamber of Parliament at 10:00 AM in accordance with the Proclamation issued by the President per Extraordinary Gazette Notification Number 2095/50 dated 4th November 2018.

Supreme Court restores parliament in boost to ousted PM

AFP - Sri Lanka's Supreme Court on Tuesday overruled President Maithripala Sirisena's dissolution of parliament in a major boost to sacked prime minister Ranil Wickremesinghe's fight to reclaim the post from an arch-rival.

The heavily guarded court also halted preparations for a snap election in the latest twist in a power struggle that began when Sirisena dismissed Wickremesinghe on October 26 and replaced him with former strongman president Mahinda Rajapakse.

The 225-member parliament could meet as early as Wednesday to decide which of the duelling pair it backs.

Amid mounting international concern, Wickremesinghe has refused to accept his sacking and has remained in his official residence while Rajapakse has sought to build a parallel administration.

Wickremesinghe's United National Party (UNP) is the largest single party in the assembly. He told reporters that he expected the legislature to meet Wednesday, as was scheduled before Sirisena dissolved the body to prevent a majority test.

"I will go to parliament tomorrow and we will show we are the legitimate government of Sri Lanka," Wickremesinghe said at the Temple Trees residence that has become the opposition headquarters.

Wickremesinghe called the court ruling a "a victory for the people and a victory for decent politics in this country."

Parliamentary officials said Speaker Karu Jayasuriya called a meeting of political party leaders on Wednesday morning ahead of a formal meeting of legislators who could vote between Wickremesinghe and Rajapakse.

There was no immediate comment from Sirisena or Rajapakse after the Supreme Court's unanimous decision.

The UNP led petitions against the dissolution of parliament and the three-judge bench, headed by the Chief Justice Nalin Perera, gave the landmark decision to a packed court guarded by hundreds of heavily armed police and commandos.

The court said it would give a final verdict on the petition on December 7, after three more days of hearings.

The judges ordered the independent Elections Commission to halt preparations for the January 5 vote, which Sirisena had announced on Friday.

- Tight security -

Security at the courtroom had been beefed up ahead of the hearing as authorities feared clashes between rival supporters.

However, there was no trouble and supporters of Sirisena melted away when it was known that parliament had been restored.

The United States, European Union and other nations have raised concerns over the crisis in the strategically important island nation of 21 million people.

Only China has recognised the appointment of Rajapakse, who during his decade as president until 2015 relied heavily on Beijing for diplomatic and financial support.

As president from 2005 until 2015, Rajapakse ended Sri Lanka's four-decade civil war in 2009 by crushing the Tamil Tigers.

But 40,000 ethnic Tamils were allegedly massacred in the process.

During his time in office from 2001 until 2004, Wickremesinghe is credited with pulling Sri Lanka out of its first ever recession, in part with reforms that have endeared him to the West.

Speaker calls Parliament to meet on Nov 14

ECONOMYNEXT - Speaker Karu Jayasuriya has called members of Sri Lanka's Parliament to meet on November 14 at 10.00 am after the island's Supreme Court suspended an order by President Maithripala Sirisena, dissolving the house.

Before the purported sacking, President Sirisena recalled parliament which was earlier suspended to give him time to buy over legislators loyal to Ranil Wickremesinghe.

Speaker Jayasuriya said according to President Sirisena's proclamation recalling parliament, the house will meet at 10.00 am tomorrow.

"The Speaker is informing all members of parliament to attend the session," the Speaker said in a statement.

President Sirisena was expected to make a policy statement on with the commencement of the new sessions.

Speaker Jayasuriya had also asked for floor test to determine whether Ranil Wickremesinghe, who was controversially sacked, or the new contested Prime Minister Mahinda Rajapaksa had the confidence of the majority of members.

Yesterday's gathering at Lipton circus and what was demonstrated at the meeting has given shock waves to MS.

The reason why he had called the evening meeting was that.

He had agreed to accept today's count on NCM by name or show of hands or voice & noise and accept the majority as declared.

By evening today, he will appoint the PM and it will be SP as per RWs request.

(But keep your fingers crossed knowing the irrational behaviour of the man we are dealing with).

yes most probably sajith will be appointed. JVP or TNA has to vote as a coalition partners of the govt that is going to be formed in order to show the majority. otherwise again it will be a minority government.

President asks for majority to be shown with name count

ECONOMYNEXT - Sri Lanka's President Maithripala Sirisena had asked party leaders who supported a vote of no confidence against disputed Prime Minister Mahinda Rajapaksa to show their majority with a name count, a statement said.

Speaker Karu Jayasuriya had already declared that Rajapaksa is no longer Prime Minister following a vote of no confidence two days ago and there was no Prime Minister in the country.

The motion also declared that gazettes appointing Rajapaksa as Prime Minister, and sacking Ranil Wickremesinghe was also null and void.

Legislators loyal to Rajapaksa blocked taking a name count and disrupted proceedings.

President had asked for the references to gazettes to be removed in any new motion, the statement said.

It is however not clear whether the President is asking for a motion already taken to be undone.

A legal analyst also question whether a motion of no-confidence can be moved against a person who has already been voted out of office and is no longer Prime Minister.

Earlier on Thursday, a motion of no-confidence was moved against a speech made by Rajapaksa in parliament.
